Court Rules Against Chile Casino
30th April 2010

The Chilean Supreme Court has ruled that the Enjoy Casino in Antofagasta needs to pay a fine and provide compensation to the family of a 23 year old woman with Down syndrome that the casino barred from entering in November 2006. The decision was a unanimous one by the court which rejected the appeal of the lower court which rule the casino to pay a fine of US$1,770 for breaching Chile’s Consumer Laws. Another part of the ruling is set that the casino must also compensate the mother of the victim US$9,500 in moral damage.

Elizabeth Flores Soria was with her daughter Paz Otero Flores in the gaming room of the Casino Enjoy Antofagasta and was asked by casino staff to leave the casino due to Paz having down syndrome. Elizabeth was humiliated and decided to seek legal help since she felt the casino had violated basic Chilean consumer law. Antofagasta is a long and narrow city in the southern part of Chile. It has a good tourism industry since it is a city with a coast line with wealthy inhabitants in various parts of the city.
